Conditions of Participation and Privacy Policy for the 2025 Pokémon Christmas Contest of Sammelkartenmarkt GmbH & Co. KG
§ 1 Subject matter
(1) These terms and conditions of participation and data protection information govern the participation in the competition of Sammelkartenmarkt GmbH & Co. KG, Nordkapstr. 4, 10439 Berlin (hereinafter referred to as the "organizer") as well as the collection and use of data collected from or communicated by participants.
(2) By participating in the competition participants accept these conditions of participation.
§ 2 Conditions of participation
(1) The participation period begins on December 10, 2025, at 2:00 CET and ends on December 17, 2025, at 23:59 CET.
(2) Every person with a valid Cardmarket account is eligible to participate. Such an account can be opened free of charge at www.cardmarket.com. Excluded are accounts held by employees of the organizer as well as employees of cooperation partners who are or were involved in the creation or execution of the competition.
(3) Every email address that exactly matches one connected to a valid Cardmarket account and that is entered into the email field while submitting a guest comment at the bottom of this page automatically participates in the competition. For each email address only the latest comment received by the end of the participation period shall be considered.
(4) Any other registration or application to participate is neither required nor possible. In particular, tickets submitted through the organizer's customer support system cannot be considered.
§ 3 Processing, payment, notification, publication of winner data
(1) Following the conclusion of the participation period, a randomized drawing from the pool of each latest comment per email address thus submitted shall determine eleven winners. The drawing shall be weighted by the number of correctly guessed game pieces in these latest comments, determined and counted at the organizer's sole discretion. The drawing shall exclude comments that identify more than five game pieces, determined and counted at the organizer's sole discretion.
(2) In the event that a winner is selected in this manner whom the organizer already selected previously as a winner for one of the organizer's 2025 Christmas contests for Flesh and Blood, for Star Wars Unlimited, for Lorcana, for One Piece, for Yu-Gi-Oh!, for Pokémon, or for Magic, determined in any order at the organizer's sole discretion, a redraw performed in the same manner shall determine a different winner, repeated as necessary.
(3) Each winner is entitled to have €150 added to their Cardmarket account's balance. All such funds shall be credited no later than ten days after the end of the participation period.
(4) Payment of any prize in cash, in kind, its exchange or transfer to other persons or accounts is not possible.
(5) The organizer may identify winners by username on the organizer's website and/or on the organizer's social media channels.
§ 4 Exclusion from the competition
The organizer may exclude from the competition certain participants who violate these conditions of participation or who attempt to influence the competition or the draw with the help of technical manipulation without notice or explanation. In such a case, prizes may also be subsequently withdrawn and reclaimed.
§ 5 Exclusion of warranty
The organizer points out that the availability and function of the competition cannot be guaranteed. The competition may be terminated or removed due to external circumstances and constraints, without this giving rise to any claims by participants against the organizer. The organizer reserves the right to change the conditions of participation at any time.
§ 6 Liability
(1) The following exclusions and limitations of liability shall apply to the liability of the organizer for damages, irrespective of any other legal obligations regarding claims.
(2) The organizer shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence.
(3) Furthermore, the organizer shall be liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations the fulfillment of which is essential to the proper implementation of the competition and on the compliance with which the contractual partners regularly rely. In this case, however, the organizer shall only be liable for the foreseeable damage typical for the contract. The organizer shall not be liable for the slightly negligent breach of obligations other than those specified previously.
(4) The above limitations of liability shall not apply in the event of injury to life, limb, or health, for a defect following the assumption of guarantees regarding the quality of a product, and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
(5) Insofar as the liability of the organizer is excluded or limited, this shall also apply to the personal liability of employees, representatives, and vicarious agents of the organizer.
§ 7 Data protection information
(1) The organizer collects and uses the data of the participants only insofar as this is legally permitted or the participants consent to it.
(2) The organizer collects the following data from participants and uses the data for the design, implementation, and execution of the competition: usernames and email addresses as well as lists of submitted guesses.
(3) Upon request in writing or any text form, participants can at any time receive from the organizer information about personal data stored by the organizer, can request correction and deletion, and can revoke consent to data use.
